The frontiers of litigation involving churches and Incorporated Trustees in Nigeria are gradually increasing from the very simple cases of contract and assault cases to the more complex and tenuous cases of crime, breach of fiduciary duties, labour, abuse and so on. This is majorly because of the perception that churches have money to pay excessive claims for damages. It is often said that litigation follows money.

Unfortunately for the churches and Incorporated Trustees, they are exposed to these litigations because of inefficient Risk Management Policies and poor governance systems.

The absence of comprehensive Risk Management Process within the church and lack of a robust governance structure has become the number one threat to the existence of Pentecostal churches, particularly in Nigeria.

‘Dayo Adebayo is the Managing Partner of ADEBAYO & ADEBAYO (Legal Practitioners). He is a PhD candidate at the University of Leicester, UK and currently researching Corporate Governance for Not-For-Profit Organizations for his thesis. He holds a Masters degree in International Business Law with Distinction from the University of Cumbria, UK and has vast experience in litigation spanning diverse areas of law in trial courts and specialized tribunals across all appellate courts in Nigeria. He has been involved in high profile litigation on labour, commercial, entertainment, banking and constitutional matters as well as non-litigation transactional legal practice involving specialized and complex multi-party commercial transactions.

He is constantly engaged by High Networth Individuals, businesses, churches and NFPO’s to offer them statutory and regulatory advice. He sits on the Board of several companies and NFPO’s and he is presently the legal counsel to several churches.
